Kemi Daisi, FCT-  The Federal High Court sitting in Abuja, today, ordered the Independent National Electoral Commission (INEC) to expunge the name of Uche Nwosu as the guber candidate of Action Alliance, AA in the last election held in Imo State.


In his judgement, Justice Inyang Ekwo voided Nwosu’s candidature on the grounds that he had obtained a double nomination of two political parties, the All Progressives Congress, APC and the Action Alliance , AA which he ruled violated section 37 of the Electoral Act.


Nwosu who was the guber candidate of the AA in the last guber elections in Imo State is presently in the Election Petition Tribunal seeking to upturn the decision declaring Emeka Ihedioha as the winner of the March 11, gubernatorial elections in Imo State.


The matter as regards Uche Nwosu’s double candidature had been brought to the High Court by the Action People’s Party , APP and the Deputy National Chairman of the party, Uche Nnadi, pleading that the candidature of Nwosu in the March 11th guber polls be made null and void on the grounds of multiplicity of nominations as a candidate of both the APC and the AA.


Ekwo, did rule that the nomination of Nwosu as the AA guber candidate was invalid, null and void, having been made at the pendency of similar nomination of the 2nd defendant (Nwosu) by the All Progressives Congress for the same position.


He similarly declared that owing to the fact that Mr. Nwosu has affirmed to be the APC’s governorship candidate in his statement on oath sworn before the High Court of the Federal Capital Territory, it was thus obvious that Nwosu “ has not been validly nominated by the 3rd defendant(AA) as it’s governorship candidate for the state governorship election having been made at the pendency of Justice Valentine Ashi  of the Abuja High Court recognizing the 2nd defendant (Nwosu) as the candidate of the All Progressives Congress for the Imo 2019 governorship election”.
